In the policy area of internal security, the law implementing the EU directive on data retention is one of the most controversial issues currently under public discussion. The focus here is particularly on data protection concerns. In 2010, the Federal Constitutional Court ruled that the concrete transformation of the EU directive into German law is not compatible with the German constitution. An agreement between the Federal Ministry of Justice and the Federal Ministry of the Interior on a new joint draft law is still pending.
